9.3 Codes of Good Practice
The Labour Relations Act provides for the development and implementation of codes of good practice. These codes serve as guidelines to promote fair labour practices and to assist employers, employees, and trade unions in understanding and applying the provisions of the Act.
The Minister of Labour, in consultation with NEDLAC (the National Economic Development and Labour Council), may issue codes of good practice on various aspects of employment, including dismissal, discrimination, workplace discipline, and dispute resolution. These codes are not legally binding but are highly influential and can be used as a reference in legal proceedings and dispute resolution.
For example, the Code of Good Practice on Dismissal provides detailed guidelines on how to conduct fair dismissals for reasons related to conduct, capacity, and operational requirements. It outlines the procedural and substantive requirements for fair dismissal, helping employers to avoid unfair dismissal claims and to ensure that their practices comply with the Act.
By following these codes of good practice, employers can foster a positive and fair working environment, reduce the risk of disputes, and promote good labour relations.
