2.2 Employers’ Right to Freedom of Association
Next, we turn our attention to the employers’ right to freedom of association. The Labour Relations Act grants every employer the right to participate in forming an employers’ organisation or a federation of employers’ organisations. Employers also have the right to join an employers’ organisation, again subject to the organisation’s constitution. This allows employers to collectively represent their interests in labour relations matters.
Members of employers’ organisations have the right to participate in the lawful activities of their organisation, participate in the election of office-bearers and officials, and stand for election themselves. For juristic persons, this means that a representative of the organisation can stand for election. This participation ensures that employers have a voice in the decisions and activities of their organisations, promoting fairness and representation in labour relations.
